RERA Extension

An extension is not the same as a delay. One follows a legal process. The other just happens.

The short answer

A RERA extension is a formal application by the promoter to push back a project's registered completion date, granted only for reasons the Act treats as force majeure. It is not the same as a promoter simply running late.

What an extension actually is

Under Section 6 of the Act, a promoter can apply to the state authority to extend a project's registration beyond the date originally declared. The application has to state a reason, and the authority has to accept that reason before granting it. An extension that appears on the public RERA filing is a matter of record, not a promoter's private decision.

What counts as force majeure

The Act defines force majeure narrowly: war, flood, drought, fire, cyclone, earthquake, or another calamity caused by nature and affecting the regular development of the project. Ordinary business problems, a cash flow shortfall, a contractor dispute, or a labour shortage, are not force majeure under this definition.

What this means for you

A promoter cannot use Section 6 to excuse a delay caused by poor planning or financial mismanagement. If the stated ground for an extension is not genuinely a natural calamity, the extension itself may not hold up if challenged before the authority.

COVID-19 was a notable exception. Most state authorities treated the pandemic as a force majeure event in 2020, and granted blanket extensions to registered projects without requiring an individual application from each promoter.

How long an extension can run

The Act caps a Section 6 extension at one year in aggregate. Some state rules allow the authority further discretion beyond that in genuinely exceptional circumstances, but a one-year extension is the general default a buyer should expect to see, not an open-ended one.

How to check if a project was extended

The state RERA portal shows a project's current registered completion date, which reflects any approved extension. If the date on the portal is later than the date in your original agreement, an extension has been granted, and the portal filing will usually show why.

Does an extension cancel your compensation

Not automatically, and this is the part promoters sometimes get wrong when explaining a delay to buyers. An approved extension changes the project's registered completion date going forward. It does not retroactively erase interest already owed to a buyer for delay that occurred before the extension was granted, and it does not override a specific possession date already promised in your individual sale agreement unless that agreement is formally amended.

Frequently asked questions

Can a promoter extend a RERA registration without telling buyers?

The extension itself is filed with the authority and shows up on the public portal, so it is discoverable, but a promoter is not always required to individually notify every buyer. Check the portal directly rather than relying on being told.

Is a cash flow problem valid grounds for a RERA extension?

No. Section 6 force majeure is limited to natural calamities such as flood, fire, cyclone, or earthquake. Financial or managerial problems on the promoter's side are not covered.

How many times can a project's registration be extended?

The Act's default cap is one year in aggregate under Section 6, though some state rules permit further extension in genuinely exceptional cases. Multiple back-to-back extensions on ordinary grounds are not how the provision is meant to work.

Does a RERA extension affect my possession date?

It changes the project's registered completion date on the RERA filing. Your individual possession date, as stated in your own sale agreement, only changes if that agreement is separately amended between you and the promoter.

Was COVID-19 treated as a valid extension ground?

Yes. Most state RERA authorities granted blanket extensions during 2020 treating the pandemic as force majeure, without requiring each promoter to file an individual application.
