What is a No Objection Certificate (NOC)?

A short letter saying somebody doesn't mind. And without the right ones, nothing completes.

The short answer

An NOC is a document confirming that a party has no objection to what you are doing.

You will need several: from the society (to transfer), the builder (to mortgage), the bank (to sell), and — for the project itself — from fire, pollution, and other authorities.

Get them EARLY. An NOC that arrives three weeks late has killed a great many sales.

The NOCs you'll need when SELLING

  • Society NOC — for the transfer, in a co-operative society. Start this early. A society can take weeks, and a buyer waiting on it may not wait.
  • No dues certificate — from the society, and from the municipal authority.
  • Bank NOC — if you have a loan. Repay it, get the release, and check the encumbrance certificate afterwards.
  • Income tax clearance, in certain cases and above certain values.

These should ALL be in the RERA filing. If they are not, ask why. A project missing its fire NOC or its airport NOC is a project with a serious problem, and the problem lands on the buyers.

How to get them — and the one rule

Start EARLY. This is the whole advice.

An NOC is a letter from someone who has no particular urgency about your transaction.

A society's managing committee meets when it meets. A bank's back office processes what it processes. A departing tenant's landlord replies when they feel like it.

Meanwhile your buyer is waiting, their loan sanction is expiring, and their patience is finite.

Apply for every NOC you will need on the DAY you decide to sell. Not when the buyer asks for it.

A great many Indian property sales fall apart not because anything is wrong, but because a piece of paper took six weeks and the buyer found another flat.

And when you get one — check it says what you need

An NOC is only useful if it covers the thing you are doing.

• Does it name the right property?
• Does it name the right parties?
• Does it permit the right act — transfer? mortgage? both?
• Is it dated and signed by someone with authority to give it?
• Does it have an expiry date? Many do.

An NOC that expires before your registration is not an NOC.
